This warranty against defects in material and workmanship (the Warranty) is provided by DreamCourts Pty Ltd (ACN 629 781 095) (DreamCourts) in respect of the structural components of our basketball ring products known as DreamHoops Adjustable, DreamHoops Fixed and DreamHoops Wall Mount (each, for the purpose of the Warranty, a Product). Parts and accessories, e.g. nets and padding, are also covered by a warranty against defects for a period of one year. For the purpose of the Warranty ‘defects’ means any imperfection that impairs the use of the Product, or parts and accessories (as the case may be), for its intended purpose.

The Warranty, which must be read subject to your rights at law (see below) is provided on the following terms:

The Warranty Period

The Warranty is a limited lifetime warranty for the structural components of the Product.

The warranty period commences from the date of the original retail purchaser’s purchase of the Product and, subject to the terms set out below, and continues

  • In the case of a Product: for the period of time that the Product is owned by the original purchaser.
  • In the case of parts and accessories: for a period of one year.

The Warranty applies to each Product that:

  • has been professionally installed by or on behalf of DreamCourts; or
  • has otherwise been installed strictly in accordance with DreamCourts’ written assembly instructions, a copy of which will be included with packaging of the Product.

If the Product is installed by someone other than a DreamCourts’ professional representative, the purchaser must take photographs of the Product’s ring anchor footing to  clearly prove that the Product has been correctly installed in accordance with DreamCourts’ written assembly instructions. The photographs must be date stamped for verification purposes. The purchaser must retain copies of the photographs for the purpose of making a claim under the Warranty (see below). DreamCourts reserves its right not to honour a claim under the Warranty if a purchaser, who self-installed the Product, cannot produce clear photographic evidence that the Product was correctly installed.

Use Of The Product And Parts And Accessories

The Warranty is conditional upon the Product being used for normal basketball activities and otherwise being maintained in accordance with any written instructions included inside and/or on the Product’s packaging.

Limitations On The Warranty

The Warranty is solely for the benefit of the original retail purchaser of the Product. The Warranty immediately ceases to exist if and when ownership of the Product is transferred to another person.

The Warranty does not extend to the replacement or repair of the Product or parts where the defect is caused by or attributable to any of the following:

  • improper installation of the Product;
  • improper use of the Product, e.g. using the Product in a manner that is inconsistent with the intended purpose of the Product or otherwise inconsistent with any written directions that accompany the Product;
  • negligence in the use or maintenance of the Product;
  • abuse or vandalism of the Product;
  • alteration of the Product;
  • fire;
  • paint, rusted parts, surface scratches, fading, discoloration, cracking or normal wear and tear that does not affect the intended functionality of the Product; and
  • damage to the Product caused by an act of God, including extreme weather, flooding, tornadoes, cyclones, wind storms, fallen trees or earthquakes etc.

Rusting of Systems

DreamHoops systems are made to last in the harsh elements of the Australian environment. Our products are hot dipped and rust treated, which allows the products to withstand rusting, and any damage the rusting may produce.

At times we see elevated levels of rust due to environmental factors in specific locations, such as beachside locations or areas exposed to significant rainfall that would speed up the rusting process with excess exposure to moisture and oxygen.

With rust warranty claims, these will be individually reviewed on a case by case basis to determine whether or not a replacement if required. The majority of rust incurred on systems are not of a structural nature, but those deemed as necessary would be replaced. Our Warranty on rust is 24 months from date of install.

However, if there is a defect in the Product, the parts or in our workmanship then, subject to the limitations above, Dream Courts will, at its discretion either repair or replace the relevant defective Product or part(s).

DreamCourts will bear the reasonable cost to repair or replace any defective Product, or parts, that have been validly claimed under the Warranty.
